Your Right to Sue YOUR Abusive Spouse
You may have the legal right to sue an abusive spouse for causing your injuries. This may arise from: hitting, beating, choking, cutting, drugging, confining, intentionally causing physical injuries, forced unwanted sex, sexually transmitted diseases, secret sex tapes, kidnapping children, death threats, threats to harm your children or pets, unauthorized showing your nude pictures, removing condom during sex without your consent, interfering in child custody, etc.
May Impact Your Divorce & Division of Property
Suing your abusive spouse may result in a money judgment in your favor - which may become a DEBT that your abusive spouse is required to pay you in a divorce. This may increase the amount of money or property you get in your divorce.
EXAMPLE: A married couple has $200,000 worth of equity in their home. Often, the divorce court equally divides the home equity and each spouse would get $100,000. However, if the husband has abused and injured the wife, the wife may also have the legal right to sue the abusive husband for causing her injuries - which may result in an additional money judgment in wife's favor against her husband (for example, $100,000). This judgment may become a $100,000 DEBT the abusive husband owes to the victim wife. Consequently, when dividing marital property, the divorce court may order the abusive husband to also pay off his $100,000 DEBT by awarding the husband's $100,000 house equity (that he otherwise may have received) over to the victim wife to pay off his DEBT to her. In this example, the wife gets 100% of the house' equity ($200,000), and husband gets nothing.
